The 1892 election was a turning point for the two factions of the Party as Cuney rallied the black and tans behind George Clark, who was a conservative Democrat. The lily-whites recommended Andrew Jackson Houston for the governorship post. Clark lost the elections, and Democratic Grover Cleveland emerged the winner of the presidency (Mowry, 1940). The black people appeared to lose the elections as their preferred candidates lost the elections. Although African Americans lost the election and control of the party, they had sent a message that they were involved in the political affairs of the US. The journey towards equal rights had just begun, and their rights could not be ignored in any way. So, a contract is any voluntary legally binding agreement between two or more people or businesses. In our case the two parties will be represented by The State of Oregon, and by Pro DX, who will provide services and goods to the first one. 1. What specifically makes this contract enforceable? Based on the English Statute of Frauds, not every contract has to be in writing to be valid and enforceable, but some contracts should be. This agreement between State of Oregon and Pro DX, should be in writing because this contract involving the providing of services (repairs, replacements, maintenances, and others) exceeding a big amount of money. To avoid misunderstandings and disagreements and to reduce the possibility of perjury by one party or the other, this contract should be in writing. Furthermore, because it can be performed in less than one year, this kind of contract can be in oral form, and it requires involving the third party (a witness) who in case of the trial will bring a reasonable and effective evidences, otherwise one of the party might deny that the contract ever existed or might disagree on the terms of the contract. Besides that this contract is a service contract, it is also a good contract because it requires implementation of goods components in modernizat ion of the software. First that prove that the contract is enforceable is the offer. * The offer is a proposal made by one person to another person for the sale and purchase of goods, to engage in a job, action participation, and provision of services. So this contract offers software system design and programming services, in the future is valued at $ 52,800.00 for the state of Oregon. * Another element mentioned in the contract is acceptance. In general acceptance of an offer is a manifestation of assent to the terms thereof made by the offeree in a manner invited or required by the offer. Acceptance in this case is described that contractor, herein Pro DX, agrees to perform the work in accordance with the terms and conditions of this contract. * Another important element found in this agreement is the legal consideration; this means that each party must provide something of value. What are the responsibilities of both parties? The important responsibilities of the contractor (therein as Pro DX) are: * To provide system design and programming services, including COBOL II, Easytrieve Plus, CICS, CA Intertest and VSAM and DB2 file structures, and make corrections approved by DHS Project Manager. * To construct or modify and implement programs/ files that will control the processing of rates on the JD/CBC system, based on DHS supplied Project Design document and criteria. * To perform design changes, programming, acceptance testing or implementation to address unforeseen error(s), newly discovered bugs and/or interfacing issues. * To demonstrate successful implementation of the production system content with the requirements of Statement of Work to DHS Project Manager. * All these services should be provided in specific limit of time and cost. While the DHS Project Manager responsibilities are: * To provide the necessary methodologies and standards that conforms to documentation standards. * To promote the rules for completing each task within time frame and approval of every task. * To define and document what testing data is needed for the CBC/512 rate structure project. * To pay for services provided by contractor herein as Professional Data Exchange (ProDX). 3. What are the possible damages and liabilities? If Pro DX breaches the contract, the possible damages can be: * The DHS might sue the party for a remedies under the law; * The Pro DX will be enforced to pay the caused damages, that can be compensatory, liquidated, nominal, and/or punitive damages. * The Pro DX can be enforced to a specific performance. Basically a decree requiring the breaching party to perform their part of the bargain in the contract. * Pro DX might meet with the terms such -Cancellation and Restitution. A non-breaching party may cancel the contract and sue for restitution if the non-breaching party has given a benefit to the breaching party. The former contract which is the subject of dispute is ââ¬Å"rescindedâ⬠(cancelled), and a new one may be formed to meet the partiesââ¬â¢ needs. * Pro DX will have to pay the attorneyââ¬â¢s fees and cost. (in case of litigation). If we will look from the DHSââ¬â¢s side, the possible damages that can appear are: * To waste time waiting for the performance; * To lose the work that should be provided after the implementation; * Damage also includes the costs of hiring another company to finish the job. The liabilities that can be provided by Pro DX are: * To provide the programs and software that will satisfy the State of Oregon; * To complete all maintenance work within time frame; * To not to exceed the cost and work hours. The liabilities that should be provided by DHS are: * To establish the criteria and methodologies necessaries to accept the new right implemented programs and software; * To make corrections (if needed) in the supplied services; * To pay money for successful implemented system. 4. What impact does a potential breach of contract have on the business? So in the case of non-fulfillment of a contract by one party (for example by Pro DX), as a result the other party (DHS) suffers losses. Breach of a contract has negative effects, and has wide ranging consequences both legal and practical to the parties to the contract: * Loss of money ââ¬â (if, for example, Pro DX refuses to form his side of the bargain on the due date or performs incompletely, in result the second party, DHS, will lose their money for this implementation and also will lose their time spend on waiting for, and somehow will lose the profit that can be made further). * Loss of time (if, for example, Pro DXââ¬â¢s programs and software will not be accepted by the DHSââ¬â¢s side, the first will result that lost their time, and some files or programs, for doing this job). * Loss of a financial partner- it can be lose a potential investor or/and the business with who you are dealing. * Loss of trust- it is bad for any business, because no one will have pleasure to make business with an entity that lost trust in the market. * Loss of markets- insufficiently active or successful business means a loss of competitiveness and loss of market. * Injury to reputation It is not good for a business reputation if word gets out that they have not honored their part of the contract. This big source of information will help me to be more capable and to feel free while signing a contract. Even when we go to a doctor these days we have to sign a contract agreeing to receive medical treatment. If speaking in special about this analysis of a contract, about knowing how and when we enter into a contract to be safer, more convenient and profitable. Obamaââ¬â¢s Appeal to Ethos is Strengthened by His Appeal to Pathos Essays
Senator Barack Obama came to Germany to speak to the people of Berlin about the deep and enduring bonds Germany and America have with one another. Senator Obamaââ¬â¢s speech was to use ethos and pathos to electrify and to motive hope to the audience. In Obamaââ¬â¢s speech, presidential candidate Obamaââ¬â¢s appeal to ethos is strengthened/ weakened by his appeal to pathos. To start, at that time Obama was not yet elected for presidency, his speech was for an effect to inspire the people of Berlin. Obama gave his speech as an attempt to the audience to see him as an astute senator, but to see him honorable to be the next president. Obama used ethos in his speech such as, ââ¬Å"Both views miss the truth: that Europeans today are bearing new burdens and taking more responsibility in critical parts of the world; and that just as American bases built in the last century still help to defend the security of this continent, so does our country still sacrifice greatly for freedom around the globe.â⬠(Obama, 24). In this sentence Obama uses ethos to inspire the Berlin people and to bring to them the truth that had happened, to walk down memory lane and to see how much the Berlin people all have progressed. Senator Obama also points out how much the United States has helped out in the past and even continues help in the future. ââ¬Å"They cut off food and supplies to more than two million Germans in an effort to extinguish the last flame of freedom in Berlinâ⬠¦, The size of our forces was no match for the larger Soviet Armyâ⬠¦, when the largest and most unlikely rescue in the history brought food and hope to the people of this city.â⬠(Obama, 7-8). As an attempt Obama had mentioned this along with many more examples was to seem trustworthy to the people of Berlin. Ob... ... look awful to a country which gave aid when that country could least afford it. It is better to recognize the bravery and the heartwarming help of kindness America has given to many countries at that time and till this day. In the end, Obamaââ¬â¢s speech had more pathos than ethos. In the beginning it seems that Obama was using ethos as equally as pathos. But, Pathos is more used than ethos, because of the emotion grabbing sentences Obama uses to grab the audience and to manipulate it. From all the pain the people of Berlin had gone through at that time, Obama wanted to use that reason to move the people of Berlin. Obamaââ¬â¢s appeal to ethos is strengthened by his appeal to pathos. Even though, pathos is used more, it does strengthen Obamaââ¬â¢s speech. Multicultural Education
This article is a response to a journal entry of a young person view on Multicultural Education in America. This article will have some similarly views and also different view on the education of your young people that is shared with the person who wrote the journal entry. Multicultural Education Only in America can someone have a strong opinion about how we should all be like in there eyes, even when we talk the same, dress the same and live in American but that is as far as it goes. Multicultural Education is unique in many ways and this type of education help build bridges that help young people excel in school and beyond. I agree that we do live in the same country, speak the language, eat the food, and do the entire thing Americans do. I also agree with is statement on the responsibility to teach to the best of there abilities to help students, as educators that it is our job to help student achieve success in school so they can be productive citizens. My assumption of this article is that the students has only seen one part of America and does not see that there are many different cultural and race that make education unique and that this make our students special. I disagree with many of the statement in the journal entry is that he is not concern with cultural or diversity. Every school around the country is divisive and each student is unique in their own special way, each student has different learning style and come from different ethic background. Cultural and Diversity One of the most important concept in teaching that the child come first not matter what cultural or diverse background they come from. As educators we ust focus our attention to the needs of the student because it they are not going to our school we as educators will not have the luxury of paying our bills, feeding our families and do the things we want to do. The focus of education need to reflect the needs of every student and cultural is another part of which this student is and by learning more about who they are we as educators will learn new ways to become effective teachers by listening to their needs. Every child is different and unique, they come many different cu ltural and different background and they each need special attention to how they learn. The diversity in education is also important because students learn better from teachers with similar language background and can relate to them in a special way. For example I can use my native language to explain a concept to my struggling students and make a connection using tools or strategies to help them understand the context. There are many example of how diversity the classroom breeds successes among students, and studies have shown that students learn well in small groups when they share their culture with one another. The important of preserving the cultural in education is very prevalent on the Navajo Nation, we have many different ways we are sharing our cultural with our native students through books, CDs, and many other ways that we share and teach them about the past and present ways of life. It is important to share your cultural with other people just so that they can learn from your people and create an understanding among people and how they live. This help reduces many misconception about different cultural and this help build a bridge of understanding between two people. Another good example of sharing our cultural at the beginning of each school year all new Anglo or African American teacher comes to our school district they experience a one week crash course on what life is like on the Navajo Reservation by having the spend several days and nights with a family in the remote desert of Arizona. They experience life with out electricity, running water and technology as well as share the experience of herding sheep or cattle, butching a sheep or farming crops. This experience for the young teacher is to show them what life is like for our young Navajo students. In Tucson, Arizona there is an elementary school does something similar with their teachers by allowing the new teachers to meet the families of their students at there home and spend sometime getting to know each other. This is helpful because the teacher become part of the family and the students relate better to the teacher, and the student is successful in with there education. There are many other example of how diversity and cultural is used in education to help student become successful in school. Cultural and diversity are interchangeable aspect of education and both complement one another, and canââ¬â¢t have one without the other one. Cultural aspect of education shape our mind and thinking beyond what is being taught at school and diversity is making the connection to who you are as a person drawing from experience and background. The importance of both cultural and diversity is to keep the past alive through stories and books, but to keep traditional alive for people come from different backgrounds and help build a bridge of understanding between two different people and this help the teachers to understand their students. In education the main focus is the students not matter what cultural or diverse background they come from we as educators should do our best to educate them, because they will be our future leaders of this great country called America.

The genus or general topic would be virtue of character, the species or the specific area of virtue of character would be the mean between the two vices excess and deficiency, lastly is the differentiating factor or what makes the species different from other forms of it which would be the situation and how individual people can reason out different outcomes from what is required from them. Virtue is an activity of the human soul and has two parts virtue of character and virtue of intellect. Virtue of intellect is wisdom and knowledge an example would be studying at school. Virtue of character is learned by action and practice an example would be learning that cheating on tests is bad and knowing not to attempt it. Reasoning out where we stand in a particular situation is not related to knowledge or studying but rather repeated application of acts so Aristotleââ¬â¢s is stating acts of character not of intellect. Nothing can be to good, have to little and you have deficiency have too much and itââ¬â¢s excess. The mean is the middle ground between too much and too little. This mean varies on person to person. An example would be too much sun. Take a 2 people one with a fair skin tone and one with a dark skin tone. The mean amount of sun for the dark skin tone would be excess to the fair skinned person and possibly give them sunburn. Give the dark toned person the mean amount of sun required by the fair toned person and you have deficiency and could led to lack of vitamin E. But itââ¬â¢s up to the individual to regulate between the two through trial and error.

Southern Voting Behavior Essays - Free Essays, Term Papers Southern Voting Behavior Southern Voting behavior since the 1960?s Voters in many areas of the U.S. are apt to vote differently as a whole from election to election. The nation has also had a decreased turnout rate for the presidential and local elections. The South has typically not followed these patterns that the rest of has seemed to be following. The Southern whites of the U.S. have typically followed and voted for the more conservative candidate and party. Where as the Southern blacks have typically (when they have been able to vote) voted for the more liberal party or candidate. The South was at one time a Democratic stronghold and has in the past 30 years become a typically conservative voting electorate. This tendency of voting by race for the liberal or conservative candidate has been a continuing occurrence. Southern turn out for elections has been significantly lower than the rest of the nation as well over the same time period. This bias of the past 30 years as well as voter turn out has only recently began to change in the So! uth. In the beginning of and prior to the 1960?s the South was a Democratic stronghold and it was rare for there to be any competition from Republicans in these non competitive states (Mulcahy p.56). A poll taken in the 1960?s showed that " the southern states were the obvious stronghold of Democratic identification. The extreme case was Louisiana, where 66% identified with the Democratic party"(Black p.44). This all began to change as the Democratic party became more liberal in its national policy views. The Democrats became too liberal in their policies concerning civil rights for the white Southerners to continue voting for them. (Mulcahy p.40). This reason along with others is what drove the Southern whites to change there voting habits of the last 100 years. The white Southerners began to vote for presidents of the Republican party and for Independents such as the Dixiecrats, because they were more conservative on a national scale. The Largest change of the Southern voters o! ccurred in 1960 when "the southern white Protestant presidential vote went Republican"(Wayne p62). This would of allowed for the democrats to lose the south if the black electorate had not voted Democrat. The black Southern voters at the time of the 1960?s were just again able to participate with their rights to vote. This was because shortly after the Civil War and reconstruction the Southern whites reduced and eventually removed the short lived black political power. They added laws that made it mandatory to take tests for voter eligibility, as well as discouraging black voting at all. This discrimination greatly reduced if not completely halted black voting in the south until the 1950?s and 1960?s. It was not until 1965 that the Voting Rights Act was passed that prohibited literacy tests for federal elections did blacks obtain their constitutional right to vote (Wayne p.70). Many blacks did in fact support the Republican party for quite a long time because they were known as the party of reconstruction and freeing of the slaves. Black voting turned towards the Democrats in the 1930?s and 40?s on the advice of "One N.A.A.C.P. leader? Turn your pictures of Lincoln to the wa! ll, the debt is paid in full"(Mulcahy p 37). This black voting for the Democrats created a problem in of its self, that the Blacks were continuing to vote for the local white conservative Democrats, that upheld the traditional Southern white views. This lead to the continued power of the oppressive whites, even though the party platform was one of reform. It was not until the early 70?s that when the Republicans won the election for the governor of Virginia was the two party system fully revived in the south (U.S. news p. 210). This two party system allowed Democrats to run on a more liberal platform, which gave the blacks the representation that they wanted. She produced two eggs, one of which yielded Helen and Polydeuces and the other of which contained Castor and Clytemnestra. It is difficult to imagine the childhood of the famous egg-born quartet. Two of them could be injured, perhaps, but not fatally; two had special gifts that made them physically and mentally superior. Apparently there was no jealousy among them. Castor and Polydeuces were so closely attached they swore to die together, even if Polydeuces could not hope to fulfill this resolve.
